Guest Waiver

GUEST LIABILITY WAIVER, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

By booking, entering, occupying, or using this property, the Guest acknowledges and agrees to the following terms on behalf of themselves and all occupants, invitees, visitors, and any other persons entering the property under their reservation.

1. Assumption of Risk

The Guest understands and acknowledges that the use and occupancy of the property, including but not limited to the building, grounds, parking areas, walkways, stairways, balconies, decks, swimming pools, lakes, ponds, docks, recreational facilities, equipment, and any other amenities, involves inherent risks which may result in personal injury, illness, death, loss, theft, or damage to property.

The Guest voluntarily assumes all risks associated with the use and occupancy of the property and agrees to use the property and all amenities entirely at their own risk.

2. Release and Waiver of Liability

​

To the fullest extent permitted by law, the Guest releases, waives, discharges, and holds harmless the Property Owner, Landlord, Property Manager, Origin Caribbean Real Estate & Investment Services, Stays by Origin Caribbean, its directors, officers, employees, contractors, agents, representatives, affiliates, and assigns (collectively referred to as the “Released Parties”) from any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs, expenses, injuries, illnesses, death, or property damage arising from or related to:

• The Guest’s occupancy or use of the property;

• The actions or omissions of the Guest or any member of their party;

• The use of any amenity, equipment, recreational feature, lake, pool, dock, fishing area, sporting equipment, bicycles, watercraft, or other facilities;

• Acts of nature, weather conditions, wildlife, insects, falling branches, uneven terrain, or other natural hazards;

• Theft, loss, or damage to personal belongings;

• Any accident, injury, illness, or incident occurring on or around the property.

3. Guest Responsibility for Damages

The Guest accepts full responsibility for any loss, damage, destruction, excessive cleaning costs, repairs, replacements, fines, penalties, or expenses arising from:

• The actions or negligence of the Guest;

• The actions or negligence of any occupant, visitor, invitee, contractor, or person permitted onto the property by the Guest;

• Breach of house rules, policies, or applicable laws.

The Guest agrees to reimburse the Property Owner and/or Property Manager for all associated costs upon demand.

4. Indemnification

The Guest agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, lawsuits, damages, judgments, penalties, liabilities, costs, and legal expenses (including reasonable attorney’s fees) arising out of or relating to:

• The Guest’s occupancy or use of the property;

• Any injury, illness, death, loss, or damage caused by the Guest or any member of the Guest’s party;

• Any claim brought by a third party arising from the Guest’s actions, omissions, negligence, or misconduct;

• Any breach of this Agreement, house rules, or applicable laws.

5. Visitors and Additional Occupants

The Guest is fully responsible for the conduct, safety, and actions of all visitors, invitees, and additional occupants entering the property during the reservation period. Any act or omission by such persons shall be deemed an act or omission of the Guest.

6. Personal Property

The Released Parties shall not be liable for any loss, theft, damage, or destruction of personal belongings, vehicles, valuables, cash, equipment, or other property brought onto the premises.

7. Compliance with Rules

The Guest agrees to comply with all house rules, safety instructions, posted notices, and applicable laws during their stay. Failure to comply may result in immediate termination of occupancy without refund and may result in additional charges.

8. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Trinidad and Tobago.

10. Acknowledgement

By making a reservation, checking in, entering, occupying, or otherwise using the property, the Guest confirms that they have read, understood, and voluntarily agreed to the terms of this Guest Liability Waiver, Assumption of Risk and Indemnity Agreement and agree to be bound by its provisions.
